Under the federal Controlled Substances Act, cannabis is a Schedule I drug. Schedule 1 controlled substances are those which, in the opinion of the United States government have a high potential for abuse and no currently accepted medical use.

And when it comes to our country’s mail delivery services, federal law trumps all other laws of the land. As a result, mailing marijuana is illegal across all modes of mail delivery. This includes private carriers such as FedEx and UPS as well as the United States Postal Service (USPS).

Marijuana and the United States Postal Service

Using USPS

Because the USPS is a federal government agency, it must strictly obey federal guidelines. Using the United States Postal Service to mail weed — even within the territorial limits of California (a pot-legal state) — is a felony under 18 U.S. Code 1716.

However, as U.S. postal workers are federal government employees, they need a warrant based on probable cause in order to search a package for drugs. According to the U.S. Postal Inspection Service, “first class letters and parcels are protected against search and seizure under the Fourth Amendment to the Constitution, and as such, cannot be opened without a search warrant.”

Since the USPS offers some protection against search and seizure, it can understandably seem to be the safest way to ship marijuana. However, if a package seems suspicious, the USPS can get a search warrant. While this might seem like an acceptable risk, the punishment for mailing drugs through the U.S. mail can include up to a year in federal prison and a fine of up to $250,000.

Using UPS or FedEx to Ship Marijuana

Using Third-Party Carriers

Unlike the USPS, private third-party carriers – such as UPS, FedEx and DHL – are not federal agencies. As such, they do not even have to obtain a warrant to search a suspicious package.

Indeed, the Supreme Court has ruled that giving your package to a third-party “removes any reasonable expectation of privacy.” This means that private carriers have the right to open and inspect any package at their own discretion.

Furthermore, large private carriers have affirmed over and over again their willingness to cooperate with federal law enforcement in cracking down on illegal drug trafficking via mail.

For example, in 2014 FedEx was indicted for conspiracy to distribute controlled substances by transporting illegal painkillers and other prescription drugs. And in 2013, UPS paid $40 million to settle a federal probe into shipping drugs from illegal online pharmacies. Though neither of these cases involved cannabis, it shows how big the incentive is for private carriers such as UPS and FedEx to monitor packages for illegal drugs.

Risks of Shipping Weed by Mail

There risks of mailing marijuana are significant. For one thing, you can be charged under either federal law or the law of the state in which the cannabis shipment originated or the state to which it was delivered. Furthermore, charges will be compounded for interstate trafficking as well as based on the quantity of the marijuana. And under federal guidelines, mailing as little as 50 grams or less of marijuana can land in the federal penitentiary for up to five years.

Worsening matters, USPS and private carriers’ employees are offered a “reward” of up to $50,000 for information leading to convictions of persons mailing illegal substances. Even if you are only the recipient of the package, if you knowingly receive marijuana in the mail, your participation in the shipment is enough for you to be charged with conspiracy to distribute an illegal substance.

In sum, postal services are not drug mules. With the rise in the number of states legalizing marijuana, the DEA is now more than ever keeping a close eye on the shipment of packages across the country.

Yes — it is possible to transport your marijuana via mail. It happens every day and people get away with it. But remember, you’re playing the odds. The best advice we can give our clients is not to use the mail to ship your pot. At the very least, mail no more than 28 grams – California’s limit on recreational marijuana possession – and only within the borders of California.

I currently reside in a nonlegal state. I really don’t have that many options on getting any good strains. I have been ordering online through gorilla seed bank out of the U.K.
I’ve made several orders never having any major problems. I use that specific seed bank because of the discrete shipping options. It arrives stashed away in a DVD case. I see a lot of seed banks use this method. My last order my package arrived open and empty. Stamped and sealed by the US Postal Service.

I was worried for a few day but was doing my reading and from my understanding no one’s allowed to confiscate your package unless they have a federal warrant. And because my package did not arrive with green customs tape I just figured it was gone for the taking.

3 weeks later cough cough
Today I received a envelope from the USPS with a transparent front. Also I should add it was opened. It contained my invoice with all my order info from the seed bank name and address included. It contained five seed packets you could clearly see in the envelope.
No DVD case and two of seed packs were missing.

Of course I am surprised that my package arrive this way. I’m shocked that I even received it at all.
Due to the nature of the situation should I be concerned?

Yes you can absolutely see everything clearly through the package. I’ve enclosed photos. You can also see at the top it has been opened. Just for the simple fact they were completely taken out of the DVD case and put in this envelope is making me question everything. Everything still fine, I have not heard anything about this. I’m just hoping I have the stupidest postal employees in the country. I have enclosed the pictures of the 1st empty package that came sealed and the second package containing the visible seeds.

  • Shipping between 1-49 plants and less than 50 kilograms of a mixture (the dry or shredded mix of flowers, stems, leaves, and seeds and its derivatives like concentrates or edibles) carries a five-year federal prison sentence, with a maximum penalty of 10 years if charged with a second federal offense
  • Shipping between 50-99 plants or 50-99 kilograms of a mixture is a 20-year sentence
  • Shipping between 100-999 plants or 100-999 kilograms of a marijuana mixture carries a five-year minimum and 40-year maximum
  • Shipping 1,000 or more plants or 1,000 or more kilograms carries a 10-year minimum and a life sentence maximum

Can You Send Hemp Through the Mail?

Thanks to the 2018 Farm Bill, industrial hemp is legal (so long as it remains under 0.3 percent THC), and can be shipped in the mail under certain conditions.

Hemp Shipping Regulations

  • USPS: in order to comply with federal law, the product must contain less than 0.3 percent THC, and accompanying records must show that the product is legally compliant – including lab tests and results, compliance reports, and licenses must be kept for no less than two years after the dates of mailing
  • FedEx: guidance updated in January 2020 allows for the shipment of hemp-derived CBD products that contain no more than 0.3 percent THC. Marijuana-derived CBD and any plants or marijuana products are forbidden
  • UPS: mailing any part of the industrial hemp plant is forbidden, but it does accept products made from hemp — including CBD — but only as permitted by applicable state and local laws

Shipping Delta-8 THC

Here’s where things get interesting. While delta-8 THC has been a lauded newcomer for cannabis businesses and consumers alike, it currently resides in a legal grey area. As delta-8 has grown more popular, the substance has come under increased scrutiny, and many states have taken steps to ban it, most recently Colorado and California, two of the nation’s largest cannabis markets.

That’s because delta-8 lies in the messy middle of legalization. Made from hemp-derived CBD, the processing of CBD into delta-8 to create an intoxicating cannabinoid could fall under the auspices of the 1986 Federal Analogue Act passed to combat synthetic “designer drugs.”

This law states that “drugs that are similar in chemical structure and have a similar effect similar to or greater than that of a controlled substance and are intended for human consumption, must be treated as a Schedule I or Schedule II controlled substance.”

As it currently stands, delta-8 has been banned even in legal cannabis states like Alaska, Arizona, and New York, and many other states have banned or restricted sales. While regulators continue to grapple with how to manage delta-8, shipping it in the mail is probably not the best idea.
